To the Nebraska Department of Water, Energy and Environment:

I am submitting public comment regarding the proposed TK Angus Construction and Operating Permit, Facility ID 124885, in Cherry County.

I ask DWEE not to issue a final permit unless the public record clearly demonstrates, with site-specific evidence, that groundwater, surface water, nearby wells, and the land-application area will be protected.

Please require and publicly explain:

• The annual manure volume and total nitrogen and phosphorus expected.
• The exact fields and usable acreage available for manure application.
• Field-by-field crop assumptions, realistic yield goals, and agronomic application limits.
• All nutrient credits from soil, irrigation water, organic matter, legumes, previous crops, commercial fertilizer, and prior manure.
• The basis for requiring or not requiring groundwater monitoring and baseline private-well sampling.
• The engineering basis for deep-pit seepage protection, inspection, leak response, emergency pumping, and closure.
• Weather, soil-condition, setback, testing, recordkeeping, reporting, and enforcement requirements.
• How amended Middle Niobrara NRD rules and groundwater-management requirements apply.
• What Cherry County and MNNRD submitted to DWEE and how DWEE addressed those comments.

I also request a public hearing in or near Valentine so residents can ask questions and hear answers on the record.
